The assessment is based solely on the company submitting the application. Applications from companies that are affiliated with other companies under group law only apply to the company submitting the application. Applications as applicant consortia (hereinafter ApCo) are permitted. ApCos must submit a legally binding ApCo declaration signed by all members and completed in full with the application (upload to the Aribal portal in PDF format, template provided by 50Hertz: “Declaration_of_applicant_consortia_template”). In particular, the aspect of compliance of the formation of the ApCo with antitrust law must be observed. Each member of the ApCo must submit the declarations and evidence required under points a), b), c) and d) of the qualification system. This applies to a limited extent to the declarations and evidence required under items e), f), g) and h) if the ApCo provides for a division of tasks and certain references can therefore only be submitted by one ApCo member; any limited submission of declarations and evidence must be explained in full by the ApCo in an annex to the ApCo declaration (upload to the ARIBA Portal). The same rules apply to ApCos as to applicants. The prequalification of the ApCo does not also include the individual prequalification of its members. Each member can apply for this separately. In the event that a company is qualified both as an individual company and as a member of a ApCo, the client canrequest the company to limit itself to one form of participation in advance of a negotiation phase. Applicants can use other companies to prove their suitability (suitability loan). In this case, a declaration of commitment from the other company must be submitted with the application, stating that it will provide a specifically defined partial service for the applicant if the contract is awarded (PDF Format, upload in Ariba portal, template provided by 50Hertz: “Suitability_Loan_Template”) +++ Assessment of the application: The processing and decision of the application for inclusion in the qualification system is carried out promptly, at the latest in accordance with the standard deadlines pursuant to Section 48 (11) SektVO. Missing information may be requested in accordance with Section 51 (2) SektVO. The awarding authority reserves the right to take further measures to verify suitability. If qualification is successful, the applicant will be included in a list of qualified companies and informed accordingly. If an applicant is not qualified, the reasons for this will be stated. If an application is rejected or the qualification is revoked, a new application can be submitted at the earliest 1 month after receipt of the rejection or revocation.
