EU Tender “Temporary staffing for software testing personnel”

Our Tender

Dear Sir or Madam,

In the above-referenced procurement procedure, we hereby submit our binding tender for the conclusion of a Framework Employee Leasing Agreement in accordance with § 19 SektVO for the provision of temporary work (Arbeitnehmerüberlassung) services in accordance with the German Act on Temporary Agency Work (Arbeitnehmerüberlassungsgesetz). The temporary workers to be provided shall perform services in the field of software testing services.

We have prepared this tender on the basis of the procurement documents (in particular the Bidding Conditions) and acknowledge those documents as binding. In addition to this Letter of Tender, our tender consists of the annexes listed in the Annex Overview at the end of this document, all of which we have either completed in full or prepared anew.

1. We offer to provide temporary workers to deliver Quality Assurance and Testing services on the terms and conditions set out in the procurement documents and in accordance with the further annexes K1 and K2 attached to this tender, at the prices stated in the enclosed Price Schedule.
2. We confirm that we have not made any changes or additions to the procurement documents. To the extent that we have completed or supplemented the forms (Annexes 1 to 9, K1 and K2), such completion or supplementation has been made exclusively in accordance with and as expressly permitted by the Tender Conditions and the other procurement documents.
3. We undertake to notify the contracting authority without delay of any change to the documents, evidence, information or declarations submitted.
4. We shall respond to any queries regarding our tender without delay, and in any event within the time limit set by the contracting authority.
5. In the event of contract award, it is intended that:

(Note: The table may be extended as required. Reference is additionally made to the requirements of Sections VIII.3 and X.3 of the Bidding Conditions.)

Where subcontractors are named, the following additional documents are enclosed:

• declarations of commitment signed by each named subcontractor (Section X.3 of the Tender Conditions);
• the form "Grounds for Exclusion and Self-Cleaning Measures" (Annex 6) completed by each named subcontractor; and
• the form "Self-Declaration on the Sanctions Regulation" (Annex 7) completed by each named subcontractor*.*
• the form External Business Partner Screening Questionnaire (Annex 9) completed by each named subcontractor*.*

1. We are aware that the submission of false or incorrect information may result in the exclusion of our tender.
2. We remain bound by this tender until the expiry of 31.12.2026 (tender validity period).
3. In accordance with Section XI.3.1 of the Tender Conditions, we hereby declare that we offer the following improvements to the contractual provisions of the Framework Agreement. Any improvement indicated below shall constitute a legally binding commitment and shall form part of the Framework Agreement concluded with us in the event of contract award.

1. We confirm that this tender, including all annexes and accompanying documents, has been prepared and is submitted in English. Where foreign-language evidence or documents are attached, certified English translations have been enclosed in accordance with Section V.5 of the Bidding Conditions.
2. We warrant that our tender fully complies with the requirements of the procurement documents. Should our tender in this respect be ambiguous, incomplete, contradictory or unclear, it shall be construed in the manner which satisfies the minimum requirements of the procurement documents.
